Documented violation

Hatem Abed

11 April 2025: order placing him in police custody in connection with a criminal case

On 11 April 2025, an order was issued placing Hatem Abed in police custody in connection with a criminal case, and he was then committed to Mornag Civil Prison. During his detention, which lasted about seven months (April–October 2025), testimonies from former prisoners indicate that he was tortured and severely beaten, particularly on the head, and subjected to harsh disciplinary punishments, including being placed in the “silloun” (isolation cell) and deprived of food and water for two days. He was later transferred to Oudhna prison, where his health deteriorated without effective medical intervention, before being taken to the emergency medical service (SAMU) in a critical condition, where his family observed clear signs of violence on his body. On 28 October 2025, the director of Oudhna prison issued a provisional release order for him even though he was in a coma, and he died the following day, 29 October 2025. On 3 November 2025, the Fourth Misdemeanour Chamber in Ben Arous ruled that the public action was extinguished owing to the death of the accused. His father filed a petition to determine the cause of death, which was rejected by the Ben Arous and Tunis 1 courts without reasons; he also submitted two complaints to the Minister of Justice and to the Presidency of the Republic, with no follow-up whatsoever as of the time this documentation was prepared.
